No, I'm a Little Shell member as well as my two daughters, and I never got notification about the elections. Where is my right to vote as guaranteed by the constitutions. Where can I get a copy of the Little Shell Tribal Constitution?

What a joke, we will never be a true tribe unless we follow the rules we have set... We need a council who is willing to get up off thier ass and make changes and work to push for recognition. It has been too long with no progress.

i feel the election was run with well given the situation and communication, or lack of. As far as nepotism who cares the people have spoken. they voted, whether it was for jessie or against Caroline. maybe if someone else were to run against jessie but it is obvious the people do not wish to see Caroline involved anymore

I had heard this about nepotism before but I ignored it because no one was being appointed to an office ... but voted on by members.
It only makes sense its not nepotism.

MEMORANDUM OPINION, 16 November 2004

TO: JOHN SINCLAIR, PRESIDENT, LITTLE SHELL TRIBE

FR: ROBERT E. LAFOUNTAIN, TRIBAL ATTORNEY

RE: OPINION RE CONFLICT OF INTEREST PARAMETERS

I have recently been requested to provide an opinion as to whether there is a conflict of interest for the daughter of the Tribal President to run for a Tribal Council position.

Issue: Does a conflict of interest preclude the daughter of the Tribal President from running for or holding the position of Tribal Council representative for the Little Shell Tribe?

The Constitution of the Little Shell Tribe of Chippewa Indians of Montana at Article I, Section I, specifies that "All officers must be qualified members of the Tribe." There is no provision in the Constitution or Bylaws which refers to conflict of interest or nepotism. Conflict of interest refers to "the situation in which a person, such as a public official, has a private or personal interest sufficient to appear to influence the objective exercise of his or her official duties." Ethics and Conflict of Interest, Michael McDonald, The W. Maurice Young Centre For Applied Ethics. Nepotism is "Bestowal of patronage by public officers in appointing others to positions by reason of blood or marital relationship to appointing authority." Blacks Law Dictionary, Revised Fourth Edition. Conflict of Interest is an easily misunderstood concept which can be readily applied in an inappropriate manner.

In the situation at hand, there is no intended appointment and there is no intended hiring to take place. The question only refers to whether the daughter can run for a political office and serve on the same Executive Board with her father who is President. Each person on the Board has individual authority to vote his/her own conscience. Nepotism or conflict of interest would only arise here if the President was to hire or employ his daughter and to place her in a position wherein he asserts supervisory authority over her and, at the same time, have some personal or financial interest in her actions. Such is not the case. The service of the daughter on the same Committee or Board as her father, in an official capacity, as an officer of the Little Shell Tribe, does not, on its face create conflict of interest, nor does it sink to the level of nepotism. If questions arise, during the tenure of the father and the daughter on the same Board, any potential conflict of interest can be avoided simply by one or the other abstaining from voting on any matter in which that person may have a personal or financial interest.

There is no conflict of interest created by the daughter of the President of the Little Shell Tribe running for the office of representative on the Council of the Little Shell Tribe. There is no known Constitutional or other official Tribal ordinance or official policy which would preclude the daughter of the President from running for and holding this office if elected. She must simply be a qualified member of the Tribe.

I am NOT satisfied with how the election went. The absentee ballots should be counted and maybe even a NEW election. I believe that if Mr. SinClair stays in as our "Chairman," we will loss all changes for Federal Recognition!! And, what about Nepotism? His daughter is on the council? We NEED TRUE Little Shell members on our council.

It is quite evident that the election procedures are a direct result of the tribal council's ineptness since they preached so mightly on the 2000 election. The only way to solve this on going problem is to follow the BIA's approach to tribal elections. Why reinvent the wheel every election since it usually ends up constant battle. We will never get Federal Recognition if we are bounced around by the "do nothing but complain" people

I believe the elections were run as efficiently as possible given the fact that our members are so spread out. Some problems were unforseen and were handled in an expedious and professional manner. My hats off to the election committee for a job well done. For those that complain about this election, remember there will be openings for committee members in elections to come. See how well you do...

I am very upset that those who sent for an absentee ballot never received theirs nor did the office even respond to these people letting them know why they never got the ballots out to them. The office has no real good explaination for doing what they did nor does the election committee!!!!!!

Imagine if you would a Federal Representative seeking information regarding legal matters concerning our tribe from within the community, and at the Montana State level. How serious at the Federal level do we wish to be considered. I want the Feds to take us very serious.

Toni Jo Atchison, Little Shell Tribal Tobacco Abuse Prevention Specialist has announced that the Tribal newsletter is FREE to all Enrolled Tribal Members. Previously, a subscription of $10 was required for the newsletter and was published quartely. The subscription cost covered monies that funded the creation, mailing of the newsletter, along with helping with office expenses. Now, with funding provided in part under a contract with the Montana Department of Public Health and Human Services, Montana Tobacco Use Prevention Program, and the Little Shell Tobacco Abuse Prevention Program, the Newsletter will be published 12 months a year. To place your name on the List for the newsletter (if you do not currently receive it), contact Toni Jo at the main office or write a letter requesting your name to be placed on it. Tribal and Non-Tribal members are still welcome and are encourgaged to send donations to the Office to help with tribal expenses.
